Аннотация: В статье представлены результаты анализа одного из малоизученных вопросов, связанных с изменением досудебного соглашения о сотрудничестве. На основе положений УПК РФ, подходов ведущих ученых, следственной и судебной практики автор приходит к выводу о том, что досудебное соглашение должно быть изменено при невыполнении отдельных обяПоказать полностьюзательств досудебного соглашения, тогда как изменение обвинения необходимости перезаключать досудебное соглашение не влечет. In 2016, the prosecutor's powers related to the implementation of the institution of the plea agreement were substantially specified and supplemented, the law made reference to the amendment of the plea agreement; however, the Code of Criminal Procedure of the Russian Federation defined neither specific grounds nor a detailed procedure for adopting such a decision, which is why this study has attempted to fill this gap the legislator overlooked. The prosecutor's right to amend the plea agreement is provided for in Clause 5.2, Part 2, Article 37 of the Code of Criminal Procedure of the Russian Federation. Part 5 of Article 317.4 of the Code of Criminal Procedure indicates the procedure for this and cases in which the plea agreement shall be amended or terminated. The law provides no other norms concerning amendment of the plea agreement; therefore, the only guide for adopting this decision is Part 5 of Article 317.4 of the Code of Criminal Procedure. This article refers to non-compliance with the obligations under the plea agreement, thus, one may conclude that any amendment of the plea agreement shall be associated with a suspect's (accused person's) non-fulfillment of their obligations. In the event of the suspect's (accused person's) refusing to fulfill their obligations under the plea agreement, the agreement, as a general rule, shall be terminated; however, sometimes certain obligations of the suspect (accused person) remain unfulfilled for objective reasons beyond the person's control. In such cases, provided that the prosecution deems the person's actual assistance to be sufficient for the plea agreement to be executed, the agreement shall be amended. The purpose of such an amendment is to exclude unfulfilled obligations and thereby bring the amount of assistance declared in the agreement into line with the actual assistance provided, as well as with the criminal case materials confirming the cooperation. Otherwise, the court will not be able to apply the relevant rules for imposing punishment (Article 62, Parts 2 and 4, of the Criminal Code of the Russian Federation), sincePart 5 of Article 317.7 of the Code of Criminal Procedure of the Russian Federation obligates the court, prior to the amendment, to make sure that the defendant has met all the conditions and fulfilled all the obligations stipulated by the plea agreement. On the issue of the procedure for amending the plea agreement, both the leading scientists' opinions and the current legislation provisions have been analyzed; as a result, the article concludes that when amending the plea agreement, the general procedure should be applied, with the investigator submitting a petition to the prosecutor and, having the resolution of the latter, making a decision on amending the plea agreement, and then a new version of the agreement shall be concluded.
